These General Terms and Conditions will prevail over any other general or specific conditions not expressly approved by “Dancehall The Time”.
“Dancehall The Time” reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order.
Article n°2: Purpose
The products offered for sale by “Dancehall The Time” are those which appear on the Site (hereinafter the “Product(s)”).
The products are offered for sale while stocks last. In the event of unavailability of the Product after placing the order, rollande.com will inform the customer as soon as possible, and if necessary will reimburse the customer no later than fourteen (14) days following payment of the amounts. paid. "Dancehall The Time" cannot be held responsible for possible input errors and the resulting consequences.
“Dancehall The Time” reserves ownership of the items until full payment of the order, i.e. receipt of the order price by “Dancehall The Time”. “Dancehall The Time” reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or who presents any form of risk in its eyes.

Article n°5: Price of the articles
All prices are indicated in euros, all taxes included, regardless of the territory in which the Customer resides, taking into account the VAT applicable on the day of the order. Any change in rate may be reflected in the price of the products.
The prices indicated are, where applicable, excluding delivery costs (see Article 8: Shipping and Delivery).
Rollande.com reserves the right to modify its prices at any time without notice. Items will be invoiced based on the rates in effect at the time the orders are placed. The products remain the property of “Dancehall The Time” until full payment of the price by the seller. The price is payable in full and in a single payment.
Article n°6: Payment
The price is due when ordering. Whatever payment method you choose, any payment will only be considered final after effective and complete collection of the sums by “Dancehall The Time”. “Dancehall The Time” accepts payments from countries around the world.
Payment for purchases is made:
• by secure payment system: Strype.
Your order will be recorded as soon as payment is accepted by the banking service. You can pay online with complete confidence by entering the number, expiry date of your bank card and the security code found on the back of your card in the spaces provided for this purpose.
Your credit card details are encrypted using the SSL (Secure Socket Layer) protocol and never pass unencrypted over the network. The seller does not have access to these contact details under any circumstances, and does not keep them on its servers. This is why you are asked for them again for each new transaction on our site.
Payment is validated upon receipt of additional information requested in the event of payment by bank card requiring additional verifications (See Article 7: Fight against bank card fraud).
By choosing to pay for the products via the aforementioned payment tools, the Customer undertakes to read and accept the general conditions of sale of the partner companies of "Dancehall The Time" governing the payment tools. "Dancehall The Time" cannot be held liable for any direct or indirect damage of any nature whatsoever linked to the use of these payment tools.
Also, you guarantee “Dancehall The Time” against any claim, action or procedure initiated against it in this respect.
The Customer's account will be debited at the time of the order.

Les délais transporteur indiqués ci-dessous sont à prendre en compte à partir du départ du colis de la Poste de Monestier de Clermont 38650. "Dancehall The Time" décline toute responsabilité quant à l’allongement des délais de livraison du fait du transporteur, notamment en cas de perte des produits, d’intempérie ou de grève.
"Dancehall The Time" s’engage à expédier les articles commandés et payés par le client dans les délais prévus, à savoir 3 à 5 jours ouvrés. Si lesdits articles n’ont pas été livrés dans un délai de 8 jours ouvrés à compter de la date de livraison prévue lors de la commande, et si ce dépassement n’est pas dû à un cas de force majeure, le client pourra procéder à la résolution de la vente par l’envoi d’un courrier recommandé avec avis de réception à l’adresse suivante : Nelly Vigoureux (Dancehall The Time), 15 chemin du vieux tilleul, Le village, 38930 St Martin de Clelles.
Les sommes versées par le client lui seront alors intégralement restituées.
En cas de retard prolongé de votre livraison, vous devrez signaler ce retard dans un délai de sept (7) jours ouvrés maximum par mail à l’adresse suivante : n.vigoureux@hotmail.fr .
Nous contacterons alors les services postaux afin d’ouvrir une enquête.
Le client est tenu de vérifier l’état des articles livrés. En présence d’une anomalie apparente du colis (notamment colis endommagé, colis ouvert, traces de liquide, etc …), le client ou le destinataire des produits commandés ne doit pas ouvrir le colis mais est invité à le rapporter non ouvert dans un délai de cinq 5 jours ouvrés dans un bureau de Poste et à y établir un constat.
L’ouverture dudit colis exclut tout recours auprès du transporteur (La Poste). Il est également invité à signaler immédiatement le problème rencontré au service client à : dancehallthetime38@gmail.com .
Le client doit signaler tout incident de livraison au service client dans les trois 3 jours ouvrées suivant la livraison (ou le refus de livraison) du produit.
Toute anomalie concernant les articles (avarie, article manquant par rapport au bon de commande, colis endommagé ou ouvert, article cassé, défectueux…) devra être impérativement indiquée dans les trois 3 jours suivant la livraison.
Faute de respect des procédures ci-dessus, aucune réclamation du client ne sera valable.
Tous les articles proposés par "Dancehall The Time" sont soumis à la garantie légale prévue par les articles 1641 et suivants du Code Civil. (Voir Article 12 Responsabilité & Garantie ).
Dès que le client a reçu le Produit, il supporte tous les risques de dommages ou de perte du Produit.
Frais de livraison et délais :
En cas d’erreur de saisie, notamment d’adresse de livraison erronée ou incomplète, le vendeur ne saurait être tenue responsable des conséquences en termes de retard ou d’impossibilité de livraison.
Tous les frais liés à la réexpédition des produits dus à une erreur de saisie du client seront à la charge exclusive du client.
Le Client peut choisir parmi les modes de livraisons suivants :
1) Standard(livraison en boîte aux lettres) en France Métropolitaine. Le tarif de la livraison est de 9€ TTC. Le délai de livraison est de 48 à 72h.
2) Colissimo DOM-TOM et International :
• Pour les DOM-TOM, le tarif est de 10€ TTC. Le délai de livraison est de 5 à 7 jours ouvrés.
• Pour le reste de l’Union Européenne (Colissimo International), le tarif varie selon le pays entre 11 et 24€ TTC. Le délai de livraison est de 5 à 10 jours ouvrés.
3) Cas particulier des pré-commandes: le délais de livraison varient en fonction des délais de réassort - un mail vous sera envoyé
une fois la pré-commande effectuée afin de vous indiquer les délais - si vous estimez que les délais ne vous conviennent pas, vous aurez alors la possibilité d'annuler votre pré-commande et Dancehall The Time se chargera d'effectuer le remboursement de votre achat dans les 48h à partir de votre mail indiquant votre choix de remboursement.
Erreurs de livraison :
Le consommateur devra formuler auprès du vendeur, le jour même de la livraison ou au plus tard le troisième jour ouvré suivant la livraison, toute réclamation d’erreur de livraison et/ou de non-conformité des produits en nature ou en qualité par rapport aux indications figurant sur le bon de commande.
Au-delà de ce délai, toute réclamation sera rejetée. Toute réclamation non effectuée dans les règles définies ci-dessus et dans les délais impartis ne pourra être prise en compte et dégagera le vendeur de toute responsabilité vis-à-vis du consommateur.
En cas d’erreur de livraison ou d’échange, tout produit à échanger ou à rembourser devra être retourné au vendeur dans son ensemble et dans son emballage en état impeccable à l’adresse du vendeur.
Pour être accepté, tout retour devra être signalé et avoir l’accord préalable du vendeur, qui en cas d’accord réexpédiera le colis à la bonne adresse.
Les frais d’envoi sont à la charge du vendeur, sauf dans le cas où il s’avérerait que le produit ne corresponde pas à la déclaration d’origine faite par le consommateur dans le bon sens de retour.
Article n°9: Withdrawal

Article n°10: Exchange and return conditions:

In the event of exercising the right of withdrawal, the consumer has the choice of requesting either a refund of the sums paid or an exchange of the product.
If the right of withdrawal is exercised, the seller will make every effort to reimburse the consumer within fourteen (14) days.
In the case of an exchange, you will receive a return slip by email to stick directly on your package to send your item back to us free of charge. (only for deliveries in mainland France).
The return costs will be the responsibility of "Dancehall The Time" only for the 1st exchange, if there should be another exchange, the return postal costs and a possible new shipment will then be the responsibility of the customer.
If the amount of the customer's exchange order is greater than the amount of their initial order, they can pay the difference online by credit card. Shipping of the customer's exchange order is conditional on validation of this payment.
If the amount of the customer's exchange order is less than the amount of the initial order, "Dancehall The Time" will reimburse the difference.
No prepaid return voucher will be sent to a customer who wishes to make a refund, only customers wishing to make an exchange benefit from a free return.
If the customer wishes a refund for their item, they must return it at their own expense via Colissimo to the following address:

The customer must keep proof of delivery of the package which will be given to them by La Poste. In the event of loss of the package, no refund will be made without this proof of deposit.
Article n°11: Condition of the Products
The returned item(s) must be new, unused, with their original labels, and in their original packaging perfectly intact.
Upon receipt of the package, “Dancehall The Time” will judge the perfect condition of the returned merchandise. No returns will be accepted if the returned items have been visibly used or damaged by the customer and this use or damage renders the items unfit for sale.
If the return is refused by "Dancehall The Time", the customer will remain the owner of the product, which he can have returned to his address at his own expense.
In the case of an exchange, if the returned items have been visibly used or damaged by the customer and this use or damage renders them unfit for sale, "Dancehall The Time" may exercise any corresponding recovery actions with the customer.
Article n°12: Refunds of returns

En cas de non-conformité d’un Produit vendu, il pourra être retourné à rollande.com qui le reprendra, l’échangera ou le remboursera.
Toutes les réclamations, demandes d’échange ou de remboursement doivent s’effectuer dans les trente (30) jours à compter de la livraison, soit par courrier soit par téléphone au 0777831995, soit par e-mail à : n.vigoureux@hotmail.fr
Article 13.2 Responsabilité de "Dancehall The Time" :
"Dancehall The Time", dans le processus de vente en ligne, n’est tenue que par une obligation de moyens ; sa responsabilité ne pourra être engagée pour un dommage résultant de l’utilisation du réseau internet tel que perte de données, intrusion, virus, rupture de service, ou autres problèmes involontaires.
Article 13.3 Limitation de responsabilité :
Le client est seul responsable des conséquences de tout dommage subi du fait de l’utilisation par un tiers de son mot de passe, de son adresse e-mail ou de(s) code(s) confidentiel(s), et de la communication de toute information que ce dernier aura rendue accessible.
Dans ce contexte, le Client garantit "Dancehall The Time" contre toute action, recours ou réclamation en rapport avec l’ensemble des éléments précités et, notamment mais sans limitation, ceux qui mettraient en cause l’utilisation des produits proposés sur le Site.
De plus, "Dancehall The Time" ne pourra être tenue responsable pour tout dommage indirect ou/et immatériel, en ce compris notamment les dommages corporels subis du fait de l’utilisation des Produits, les pertes de réputation, d’image, de données, susceptibles de survenir de la fourniture des Produits proposés sur le Site et/ou l’impossibilité d’accéder ou d’utiliser ces derniers.
Par ailleurs, le Site contient des liens et des visuels publicitaires, promotionnels, commerciaux ou de parrainage vers des sites Internet de tiers revendeurs ou prestataires de services indépendants.
"Dancehall The Time" n’est pas responsable des contenus desdits tiers ou sites tiers, n’en garantit ni l’exactitude, ni la validité, ni la qualité, ni l’intégrité, en particulier dans le cadre de transactions effectuées directement entre le Client et un tiers revendeur ou prestataire indépendant.
De même, "Dancehall The Time" ne saurait assumer les coûts de connexion, et de manière générale, tous coûts de communication induits par l’accès de Client au Site et à son utilisation.
Par ailleurs, "Dancehall The Time" ne pourra être tenue responsable du dommage direct, personnel et certain subi par le Client et pour lequel il aura été démontré que les agissements de "Dancehall The Time" ne sont pas à l’origine de ce préjudice.
"Dancehall The Time"n’assume aucune responsabilité en cas de téléchargement de virus informatique à partir de ce Site.
De plus, les photographies et illustrations accompagnant les Produits sur le Site n’ont pas de valeur contractuelle et ne sauraient donc engager la responsabilité de "Dancehall The Time".
Article n°14: Intellectual property
"Dancehall The Time" owns all intellectual property rights relating to the content accessible on this Site, in particular the texts, images, sounds, data, photographs, videos, logos, brands, designations, tabs, functionalities and any other material or software, which are protected by rights held by it or its third-party partners (hereinafter the “Site Components”).

Article n°15: Force Majeure

These cases of force majeure suspend the obligations of "Dancehall The Time", cited in these General Terms and Conditions, for the entire duration of their existence.
However, if a case of force majeure lasts longer than three (3) months, one or other of the parties would be justified in terminating the contract, after sending a registered letter with acknowledgment of receipt, announcing this decision.
Article n°16: Applicable law – Dispute resolution
These General Terms and Conditions are subject to French law.
The language of this contract is French. The parties will endeavor to resolve any dispute relating to the services of "Dancehall The Time" covered by the T&Cs amicably.
In the event of persistent disagreement, the dispute will fall under the jurisdiction of the Courts of Grenoble (France), including in the event of multiple defendants.
Article n°17: Consequence of the nullity of a clause
If one or more provisions of these T&Cs are held to be invalid by a law or regulation, or declared such by a final decision of a competent court, they will be deemed unwritten, the other provisions of these T&Cs retaining all their validity. force and their scope, as not being able to affect the validity or continuation of contractual relations as a whole, unless it is a clause which was of a decisive nature for one of the parties at the date of conclusion contractual relations.
In this case, "Dancehall The Time" and the Client must negotiate in good faith with a view to replacing this clause with a valid clause reflecting their initial wishes.
